Please read these Terms of Service carefully before using digitalpandeji.com or engaging the Fractional CMO services provided by Divyaprasad Pande.

1. Scope of Services

Divyaprasad Pande provides marketing strategy, fractional executive leadership, and GTM consulting services exclusively for B2B SaaS companies. The specific scope of work, deliverables, timelines, and compensation for any formal engagement will be detailed in a separate, written Statement of Work (SOW) or Consulting Agreement signed by both parties.

2. Client Responsibilities

For any consulting engagement to be successful, clients are expected to provide timely access to necessary data, marketing platforms, analytics tools, and team members. Delays in providing access or required feedback may impact the delivery timelines outlined in the SOW.

3. Intellectual Property

  • Custom Deliverables: Upon receipt of full payment, all custom strategies, roadmaps, and marketing materials created specifically for your company will become your exclusive property.
  • Pre-existing Methods: Divyaprasad Pande retains ownership of all pre-existing methodologies, frameworks, templates, and processes utilized during the engagement. You are granted a license to use these frameworks internally for your business operations.

4. Confidentiality

We treat all client data, pipeline metrics, financial information, and strategic roadmaps with strict confidentiality. Non-Disclosure Agreements (NDAs) can be executed upon request prior to deep-dive discovery sessions or the commencement of formal services.

5. Limitation of Liability

While our consulting services are designed to improve pipeline visibility, CAC optimization, and ARR growth, marketing involves market variables outside of our direct control. Divyaprasad Pande provides strategic direction and execution oversight but does not guarantee specific financial results or business outcomes. Liability in connection with the services provided is limited to the total consulting fees paid under the applicable agreement.

7. Governing Law

These terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Pune, Maharashtra, India. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
